Terms of Service

Welcome to EasyApplAI ("Company", "we", "us", "our"). These Terms of Service ("Terms") govern your use of our web application and services (collectively, the "Service"), which assists users in creating Curriculum Vitae (CVs), cover letters, and includes an AI photo generation feature.

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you affirm that you are at least 18 years old or the age of legal majority in your jurisdiction, and you are competent to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

EasyApplAI provides tools to help users generate professional documents like CVs and cover letters based on the information provided by the user. The Service also includes an optional feature utilizing artificial intelligence to generate profile photos based on images uploaded by the user.

The quality and accuracy of the generated documents and photos depend significantly on the information and images you provide.

3. User Responsibilities

  • You are responsible for the accuracy, legality, and appropriateness of all data and information you provide to the Service, including personal details for CVs/cover letters and images for photo generation.
  • You must ensure you have the necessary rights and permissions to upload any images used with the AI photo generation feature.
  • You are responsible for maintaining the confidentiality of your account information, including your password.
  • You agree not to use the Service for any unlawful purpose or in any way that could harm the Service, the Company, or other users.
  • You agree not to attempt to reverse engineer, decompile, or otherwise attempt to discover the source code of the Service.

4. Intellectual Property

  • Our Content: The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of the Company and its licensors.
  • Your Content: You retain ownership of the personal information and images you provide ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and display your User Content solely for the purpose of providing and improving the Service.
  • Generated Content: You own the final CVs and cover letters generated using your User Content. For AI-generated photos, you may use them for personal and professional purposes (including on your CV, professional profiles, and websites), while the underlying AI models and processes remain our property. We make no claim to the copyright of AI-generated images based solely on your input, but AI-generated works may not be eligible for copyright protection depending on the jurisdiction.

5. AI Photo Generation

  • The AI photo generation feature uses complex algorithms. The results may vary and might not always meet expectations or perfectly resemble the input images.
  • You acknowledge that AI-generated content can sometimes be unexpected or contain artifacts. We are not responsible for the specific output of the AI.
  • You agree not to use the AI photo feature to create misleading, harmful, offensive, or infringing content.
  • You may only upload photographs of yourself, or of another person who has given you their explicit permission. Uploading or generating images of a person without their consent may violate that person's personality rights (including the right to their own image) and is strictly prohibited.
  • You must not use generated photos to impersonate another person, to deceive or mislead third parties, or for any unlawful, defamatory, or fraudulent purpose. We reserve the right to suspend or terminate your access to the feature in case of abuse, without refund.
  • Use of the feature is subject to a monthly generation allowance that depends on your subscription plan. Generations that you delete still count toward this allowance.
  • Subject to these Terms, you may use the photos generated for you for personal and professional purposes. AI-generated images may not be eligible for copyright protection in some jurisdictions, and we do not guarantee that the generated images are free of similarities to other AI-generated content.

6. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WHILE WE IMPLEMENT SECURITY MEASURES (AS DETAILED IN OUR PRIVACY POLICY), WE CANNOT GUARANTEE THE ABSOLUTE SECURITY OF YOUR DATA. YOU ACKNOWLEDGE THAT TRANSMITTING INFORMATION OVER THE INTERNET IS INHERENTLY RISKY.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

THIS INCLUDES, BUT IS NOT LIMITED TO, DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, DATA BREACHES, OR ANY OTHER MATTER RELATING TO THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US, IF ANY, FOR USING THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service; b) a breach of these Terms; or c) User Content you submit or transmit through the Service, including any claim that your User Content infringes the rights of a third party.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
